Terms of Service

By accessing or using simplynickish.com, any of its sub-domains, or any apps provided through the platform (collectively, "the Service"), you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time. Continued use after an update constitutes acceptance of the new terms.

You must be at least 13 years old to create an account. If you are located in the European Union, you must be at least 16 years old (or the applicable digital consent age in your member state, if lower). By creating an account, you represent that you meet the applicable age requirement for your jurisdiction.

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately of any unauthorised use.

You may not create accounts using automated means, or for the purpose of violating these terms.

Some features of the Service require a paid subscription. By subscribing, you authorise SimplyNickish to charge the payment method you provide on a recurring basis at the rate shown at the time of purchase.

Subscriptions automatically renew unless cancelled before the next billing date. You can cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — we do not offer pro-rata refunds for unused time except where required by law.

We may change subscription prices with at least 30 days' notice. If you do not accept a price change, you may cancel before it takes effect.

Early access codes are personal and non-transferable unless explicitly stated otherwise. Each code may only be redeemed by the intended recipient. Selling, distributing, or publicly sharing codes without authorisation is prohibited and may result in account termination.

Early access benefits (free access periods, tier unlocks) are granted at our discretion and may be modified or revoked if the terms are violated.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Transmit spam, malware, or any harmful code
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Scrape, crawl, or extract data from the Service in bulk without written permission
• Harass, threaten, or harm other users
• Impersonate SimplyNickish, its staff, or any other person or entity

We reserve the right to suspend or terminate accounts that violate these terms without notice.

All content on the Service — including but not limited to the software, design, logos, text, graphics, and product names — is the property of SimplyNickish or its licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

If you submit any content through the Service (e.g. feedback, profile information), you retain ownership of that content but grant SimplyNickish a worldwide, royalty-free licence to use it to operate and improve the Service.

You are solely responsible for any content you submit and represent that you have the right to share it.

The Service integrates with third-party platforms including Stripe, Supabase, and OAuth providers (Google, Discord, Twitch, X). Your use of these integrations is also subject to the relevant third-party terms of service.

We are not responsible for the content or practices of any third-party services.

The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, SimplyNickish shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at our discretion if you violate these terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so, including intellectual property, disclaimer, and limitation of liability sections.

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
